Terms of Service

1. Acceptance of Terms

By accessing or using Plaxt ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. The Service is operated by the operator of Plaxt, based in Belgium ("we", "us", or "our").

2. Eligibility

You must be at least 16 years old to use the Service. By creating an account, you represent that you meet this age requirement. If you are under 18, you confirm that you have obtained parental or guardian consent to use the Service.

3. Description of Service

Plaxt is a media scrobbling service that syncs watch activity from media servers and streaming services to tracking services. The Service requires you to have accounts with the third-party services you wish to connect.

4. License to Use the Service

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes. This license does not include the right to sublicense, resell, or distribute the Service or any part of it.

5. Account Registration

To use the Service, you must create an account with accurate information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

You agree not to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service
• Reverse engineer, decompile, or disassemble the Service

• Share your account with others or resell access to the Service
• Circumvent any usage limits or restrictions

The Service integrates with third-party media servers and tracking services. Plaxt is not affiliated with or endorsed by any third-party service provider. Your use of those services is governed by their respective terms and privacy policies.

You are solely responsible for ensuring you have the authorization to connect third-party services and share data with them. We may disable integrations if required by third-party policies or applicable law.

We are not responsible for:

• Changes to third-party APIs that affect the Service
• Actions taken by third-party services on your account
• Data handling by third-party services

9. User Content

You retain ownership of any data you provide to the Service, including watch history and account information ("User Content"). By using the Service, you grant us a limited, non-exclusive license to process, store, and transmit your User Content solely to provide and improve the Service. This license terminates when you delete your account.

10. Intellectual Property

The Service and its original content, features, and functionality are owned by Plaxt and are protected by copyright, trademark, and other intellectual property laws. Plex, Trakt, Simkl, Emby, Jellyfin, and Netflix are trademarks of their respective owners.

11. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE ARE NOT RESPONSIBLE FOR MISSED SCROBBLES OR SYNC FAILURES DUE TO THIRD-PARTY SERVICE OUTAGES. NOTHING IN THESE TERMS EXCLUDES WARRANTIES THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PLAXT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM. NOTHING IN THESE TERMS LIMITS LIABILITY FOR DEATH, PERSONAL INJURY CAUSED BY NEGLIGENCE, FRAUD, OR ANY LIABILITY THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.

13. Indemnification

You agree to indemnify, defend, and hold harmless Plaxt and its operator from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms, your misuse of the Service, or your violation of any third-party rights or terms of service.

14. Service Availability

We strive for high availability but do not guarantee 100% uptime. We may modify, suspend, or discontinue the Service (or any part) at any time. We will provide reasonable notice for significant changes when possible.

15. Force Majeure

We are not liable for any failure or delay in performing our obligations where the failure or delay results from events beyond our reasonable control, including but not limited to natural disasters, internet or infrastructure outages, third-party service failures, government actions, or cyberattacks.

16. Termination

We may terminate or suspend your account if you materially breach these Terms, if your conduct is harmful to other users or third parties, or where required to protect the security, integrity, or legal compliance of the Service. Where reasonably possible, we will provide notice before termination. You may delete your account at any time through your account settings.

17. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service at least 30 days before they take effect. Continued use after the effective date constitutes acceptance of the updated Terms. If you do not agree with the changes, you may close your account before they take effect.

18. Governing Law

These Terms are governed by and construed in accordance with the laws of Belgium. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Brussels, Belgium. This does not affect your rights as a consumer under mandatory consumer protection laws of your country of residence.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
